EndSARS: ‘Activist’ files criminal complaint against Yesufu, Yemi Alade, Paul Okoye, 2 Baba, Sam Adeyemi, 45 others

A man, who claimed to be a human rights activist, Kenechukwu Okeke, has filed a criminal complaint before a Chief Magistrate’s Court of the Federal Capital Territory (FCT) against 50 persons, including activists, musicians, celebrities, football stars, musicians, among others.



Okeke, who said he resides at Plot 224, Gana Street, Maitama, Abuja, claimed, in a document he filed along with the complaint that the defendants, between October 2 and 28, 2020 using Twitter, a micro blogging and electronic social networking service, conspired among themselves to commit misdemeanor, to wit, “promoting or acting in such a manner with intent to assist in promotion of an unlawful assembly under the guise of or composure of ” #ENDSARS.”

He added, in the criminal complaint filed under Sections 88, 109(a), 110(1) (c) of the Administration of Criminal Justice Act (ACJA), 2015, that by their alleged actions, the defendants committed an offence punishable under Section 97(2) of the Penal Code Act, C53 Laws of the Federation of Nigeria, 2004.



Okoye stated the first to the 50th “accused persons with intent to carry out some common purpose, assemble in such a manner, or, being assembled under the composition of ‘#ENDSARS’ as to cause persons in the Federal Capital Territory, Abuja, to fear on reasonable grounds that such assembly needlessly and without any reasonable occasion may provoke other persons to tumultuously to disturb the peace”.

He claimed his movable properties were “egregiously destroyed by some riotous and tumultuous person (s) instigated and incited by the first to 50th accused persons.”

Okoye, in the court document, described himself as “a human rights activists, an M. Juris, conversant with the laws of the Federation of Nigeria and a tax payer committed to ensuring the peace, security as well as good governance of the Federal Republic of Nigeria.”

In a tweet, he posted on his Twitter handle, @HumanRightNG, Okeke stated: “Having initiated criminal proceedings against the #EndSARS riots promoters at exactly 1052hrs WAT, 09/11/2020, we shall ensure that same is diligently prosecuted in the interest of defence, public safety and public order. The Federal Republic of Nigeria is country of laws.

“There is a motion (ex parte) praying the magistratus for an order directing that the charges and other subsequent court processes in relation to the criminal proceedings be effected on the accused persons by posting, publishing and sharing same as they become due via @Twitter.

“Having regards to the case of Esso West Africa Inc. vs. T. Oyegbola (1969) NMLR 194 (198) wherein the Supreme Court of Nigeria opined, thus:

“The Law cannot be and is not ignorant of modern business methods and must not shut its eyes to the mysteries of the computer.”

Listed as defendants are Aisha Yesufu, David Adeleke, Peter Okoye, Paul Okoye, Folarin Falana, Nwankwo Kanu, Oseyi Etomi, Sam Adeyemi, Yemi Eberechi Alade, Fakhrriyah Hashim, Temitope Majekodunmi Oanu-Davis, Olorunrinu Oduala and Jola Ayeye.

Others include Laila Johnson-Salami, Anita Natacha Akinde, Oghenekaro Ibadaomu, Ikuforijin Abdulrahman Olaitan, Ojabodun Ademola, Deji Adeyanju, Dr Joe Abah, Bankole Wellington, Uche Jombo Rodriguez, Module Odele, Kiki Mordi, Damini Ebunoluwa Oguli, Tiwa Savage and Ayodeji Richard Makun.

Also listed as defendants are: Chibuzor Nelson Azubuike, Apaokagi Adedoyin Maryam and Ayo Sogunro, Pamilerin Adejoke, Japhet Omojuwa, Chinedu Okoli, Michael Collins Ajereh, Yul Edochie, Innocent Idibia, Debo Adebayo, Feyikemi Abudu, among others.
